The web scraping tool uploaded by Google claims that Google is scraping the web

SerpApi is a company that provides tools for scraping content on the web Fight back against Google’s copyright lawsuit accuses it of hollowing out search results “on a staggering scale.” In a Motion to dismiss filed FridaySerpApi claims that Google does not own the copyright to its search results, claiming that the engine was created “at the expense of others who spread ‘the world’s information’.”

In December, Google filed a lawsuit against SerpApiclaiming that the smaller scraper had violated copyright law by using “deceptive means” to access and extract its search results. Google also claims that SerpApi has found a way to bypass SearchGuard’s anti-scratch feature. But SerpApi’s motion to dismiss argues that Google is “the biggest data miner on the planet,” and that SerpApi is only doing “what Google does to everyone else:”

Just like Google – but on a much smaller scale – SerpApi uses “automated means” to scrape public websites, which it then aggregates and makes available to its customers in ways it thinks they will find relevant and useful. This, of course, is exactly what Google does.

SerpApi claims that Google “claims no ownership” of its search results, and that “the information it extracts from public websites is not protected by copyright access controls.” The company also claims that it did not violate copyright law by circumventing SearchGuard, because the tool is allegedly only designed to protect Google’s works — not licensed content.
