Immigration agents and law enforcement officers usually rotate in hospitals because someone they have detained suffers from a medical crisis. There are protocols for these agents or employees when dealing with a detainee or arrested. But the latest cases of high -profile immigration raise alarms whether these guidelines are sufficient to protect hospitals and legal and privacy rights.
For 15 days in July, immigration and customs law enforcement agents have occupied the Glendale Glendale Memorial Hospital. They were waiting for a patient, an immigrant from El Salvador, to be released for medical attention after their detention. Agents stood Behind the admission desk In the lobby, while the protesters gathered outside the hospital, protesting ICE’s presence.
Hospital officials said in a statement that they could not prohibit law enforcement agencies from being in public areas. Although agents cannot wander through the facilities without inspection, the rules are more dark when they introduce someone who is in custody.
State legislation and Hippa’s confidentiality rule also require hospitals to protect patients’ personal and health information. Some disclosures are required if the law enforcement agencies can prove legitimate detention or give an appropriate order – although administrative orders from ICE do not require immediate access to information.
