Cleannet USA sold Californians’ porter franchises using unfair and fraudulent practices, then misclassified porters and refused them with employment rights, such as a minimum wage and supply recovery, according to the State last week after investigating the General Prosecutor’s Office.
The national company and its four California operators in the Gulf region, Sacramento, South California and San Diego have to pay $ 1.7 million in restitution to more than $ 200 and $ 150,000 civil sanctions on agreement with the state.
The company has to change its franchise business model and it will be forbidden to sell franchises to sole owners or businesses with less than two employees. It will also be monitored by the State Ministry of Justice for at least three years to prove that it meets the agreement, which is waiting for the court’s approval.
The agreement says Cleannet denies all the allegations. Robert Erickson, a national director of the company, said in an email that Cleannet was “pleased” that his conversations with the state had led to an agreement.
